General conditions

You will find below the general conditions of ALTIUS CVBA ("ALTIUS"). These general conditions apply to all services rendered by the partners, lawyers, employees and/or appointees of ALTIUS within the scope of its normal activities.

  1. ALTIUS is a civil company with registered office at Tour & Taxis, Avenue du Port 86C box 414, 1000 Brussels - Belgium and with company number 0476.389.071, that has taken the form of a cooperative company with limited liability (coöperatieve vennootschap met beperkte aansprakelijkheid).
  2. ALTIUS is the exclusive contracting party for all services performed by its lawyers, employees and/or appointees.
  3. The total liability of ALTIUS with respect to the services provided is limited to the payment of its professional liability insurance. On request, a copy of the insurance policy can be obtained.The professional liability insurers are HDI Gerling Assurances, Starr Underwriting AGEBT LTD, AIG Europe and Ethias.
  4. Unless explicitly agreed otherwise, the fees due by the client are calculated by multiplying the number of hours worked by the applicable hourly rate that applies to the person who has rendered the services within ALTIUS, as determined by ALTIUS. These fees are increased with costs.
  5. Invoices sent by ALTIUS to clients have to be paid immediately after receipt of the invoice. If the invoice is not paid in time, ALTIUS is authorized to charge, in addition to the principal amount, the statutory interest and an additional fixed payment of 10,5% of the principal amount to cover the administrative costs.
  6. The legal relationship between ALTIUS and its clients is governed by Belgian law. Disputes shall be settled by the courts of Brussels.

 

Algemene voorwaarden

Hierna vindt u de algemene voorwaarden van ALTIUS CVBA (hierna 'Altius'). Deze algemene voorwaarden zijn van toepassing op alle werkzaamheden uitgevoerd door de vennoten, advocaten, werknemers en/of aangestelden van ALTIUS binnen het kader van haar normale activiteiten.

  1. ALTIUS is een burgerlijke vennootschap met maatschappeljke zetel te Tour & Taxis, Havenlaan 86C bus 414, 1000 Brussel - België en met ondernemingsnummer 0476.389.071, die de vorm van een coöperatieve vennootschap met beperkte aansprakelijkheid heeft aangenomen. 
  2. ALTIUS is de exclusieve contractspartij voor alle diensten geleverd door haar advocaten, werknemers en/of aangestelden.
  3. De totale aansprakelijkheid van ALTIUS m.b.t. diensten geleverd is beperkt tot de uitkering van haar beroepsaansprakelijkheidsverzekering. Op eenvoudige vraag kan een kopie van de verzekeringspolis worden bekomen. De beroepsaansprakelijkheidsverzekeraars zijn HDI Gerling Assurances, Starr Underwriting AGEBT LTD, AIG Europe and Ethias
  4. Tenzij uitdrukkelijk anders overeengekomen, worden door de cliënt de verschuldigde erelonen berekend aan de hand van het aantal uren besteed, vermenigvuldigd met het toepasselijk uurtarief van toepassing op de persoon die de diensten heeft geleverd binnen ALTIUS, zoals vastgesteld door ALTIUS. De erelonen worden verhoogd met de kosten.
  5. Door ALTIUS aan de cliënt verzonden facturen dienen onmiddellijk te worden voldaan. Bij gebreke van tijdige betaling is ALTIUS gerechtigd de wettelijke rente in rekening te brengen en een forfaitaire vergoeding van 10,5% van het hoofdbedrag ter dekking van administratieve kosten.
  6. De rechtsverhouding tussen ALTIUS en de cliënt is onderworpen aan Belgisch recht. Geschillen zullen uitsluitend worden beslecht door de rechtbanken van het arrondissement Brussel.

Ci-dessous vous trouverez les conditions générales de ALTIUS SCRL (ci-après ALTIUS). Ces conditions générales s'appliquent à tous les services rendus par les associés, les avocats, les employés et / ou les préposés de ALTIUS dans le cadre de ses activités normales.

  1. ALTIUS est une association civile avec siège social sis à Tour & Taxis, Avenue du Port 86C boîte 414, 1000 Bruxelles - Belgique et avec numéro d'entreprise 0476.389.071, qui a pris la forme d'une société coopérative à responsabilité limitée.
  2. ALTIUS est la partie contractante exclusive pour tous les services rendus par ses avocats, employés et / ou préposés.
  3. La responsabilité maximale de ALTIUS concernant les services fournis est limitée à la couverture prévue par son assurance couvrant sa responsabilité professionnelle. Une copie de la police d'assurance peut être obtenue sur demande. Les assureurs "responsabilité professionnelle" sont HDI Gerling Assurances, Starr Underwriting AGEBT LTD, AIG Europe and Ethias.
  4. Sauf dérogation expresse, les honoraires dus par le client sont calculés sur base du nombre d'heures consacrées, multiplié par le tarif horaire applicable pour la personne qui a fourni les services au sein de ALTIUS, tel que fixé par ALTIUS. Certaines charges seront ajoutées aux honoraires.
  5. Les factures envoyées par ALTIUS au client doivent être payées immédiatement. Faute de paiement dans les délais, ALTIUS est habilitée à facturer l'intérêt de retard légal et une indemnité forfaitaire de 10,5% du montant principal couvrant les dépenses administratives.
  6. La relation entre ALTIUS et le client est régie par le droit belge. Les litiges seront uniquement tranchés par les tribunaux de l'arrondissement de Bruxelles.
